  • 为确保国际友好城市报批工作顺畅进行,进一步规范我区友城报批程序,推动我区国际友好城市工作健康、稳定、协调发展,现将有关程序整理如下,请参照执行。欲缔结国际友好城市的双方,在实现互访并签订友好交流备忘录(友好交流意向书)的基础上,双方经过一定时间的了解和交流,条件成熟时,应按下列程序报批,待批准后方可与对方签订正式友好城市关系协议书。(一)  报批材料1.要求与外国某城市建立友好城市关系的请示;2.我驻外使领馆的意见;3.建立友好城市关系协议书中、外文本(草案);4.结好双方城市基本情况简介(中文);5.双方友好交流备忘录(友好交流意向书)复印件;6.双方开展交流情况的简介。(二)报批程序1.省级友城(1)以自治区外事办的名义向我驻外使领馆发函征求意见,使领馆复函同意后,自治区外事办行文报自治区人民政府审批。(2)自治区人民政府批复同意后、将材料(包括电子文档)交由自治区外事办友协友城处负责向全国友协行文报批。2.地级市友城(1)各市将以市政府名义上报自治区人民政府的文件及电子文档材料送交自治区外事办友协友城处。(2)自治区外事办行文向我驻外使领馆征求意见,使领馆复函同意后,由自治区外事办上报自治区人民政府审批。(3)自治区人民政府批准同意后,由自治区外事办行文报中国人民对外友好协会审批。(4)收到全国友协签发的结好批文后,自治区外事办向各市外办下达批复件。(5)结好获批准后,双方经协商自行确定签署缔结友好城市关系协议书的时间、地点和方式,在一年内完成与对方城市正式签署建立友好城市关系协议书文本等有关程序。协议书在双方地方政府领导人(或指定的代表)共同签署后生效。双方签字后的协议书中、外文本复印件抄送自治区外事办友协友城处报全国友协备案。 【阅读更多】

言中华人民共和国政府根据《维也纳外交关系公约》和《中华人民共和国外交特权与豁免条例》保障外国驻华使馆及其人员享有上述《公约》和《条例》所赋予的外交特权与豁免。为便于使馆有效执行公务和方便使馆人员的日常生活,我们将中方现行的礼宾须知和做法汇编成册,印制了这本“驻华使馆礼宾指南”,供使馆在华办理礼宾事项时参考。国际组织驻华代表机构可参照办理有关事宜。若有关规定和程序发生变动,请以主管部门的通知、公告或解释为准。 一、大使到、离任活动(一)大使到任活动1、抵达北京(1)请使馆将新任驻华大使抵京的具体时间、航班(车次)和随行人数提前1周书面通知使团办。(2)使团办将派代表前往机场(车站)迎接,提供机场(车站)贵宾室,给予免检免验礼遇。(3)交通工具和住地请使馆自行安排。2、递交国书副本使团办负责人将接受大使任命国书副本和前任大使召回国书副本,并向大使介绍递交国书的程序和有关事宜。3、递交国书(1)大使递交国书副本之后,使团办将视国家主席日程尽快安排大使向国家主席递交国书。(2)递交国书的日期和具体时间确定后,使团办将通知使馆有关事项和具体安排。(3)外交部提供大使递交国书往返乘坐的礼车,随行外交官乘使馆车辆。服装:民族服装,西服或礼服。4、礼节性会见(1)国务院总理将集体会见到任大使,不再安排其他领导人会见。(2)如大使拜会有关部门负责人,请使馆直接与有关部门联系。(二)大使离任活动1、离任日期请使馆将大使离任日期尽早书面通知使团办。2、饯行外交部主管副部长(或部长助理)将设宴为大使饯行。3、辞行拜会如大使辞行拜会有关部门负责人,请使馆直接与有关部门联系。4、离京送行(1)请使馆将大使离京的日期,具体时间、航班(车次)、随行人数尽早书面通知使团办。(2)使团办将派代表前往机场(车站)送行,提供机场(车站)贵宾室,给予免检免验礼遇。 二、证件申办(一)身份证件使馆常驻人员及其家属到任后,应向使团办申办相应的身份证件。身份证件应在外出时随身携带,遇军警哨卡及有关部门查询时主动出示。1、身份证件的种类“外交人员证”发给使馆中持有外交护照的外交代表及其配偶;“行政技术人员证”发给使馆中持有公务、官员、特别、其他公务类护照的行政技术人员、服务人员及其配偶;“国际组织人员证”发给驻华国际组织代表机构中享有特权与豁免的常驻人员及其配偶;“居留许可证”发给上述三类证件持证人的单独持有护照的随任子女(与父亲或母亲合用一本护照的子女不需办理“居留许可证”)、父母、配偶的父母及其他家属。2、身份证件的申办使馆常驻人员及其家属抵京后,有关使馆或机构应在十日内照会(附中文译文)外交部使团办,申请办理相应证件。办理证件需在“驻华外交机构及国际组织事务管理服务系统”(网址:http://protocolservice.mfa.gov.cn/lbs/login.jsp,外交部网站礼宾服务栏目页面右上角也有登录界面)中填报申请人相关信息并向使团办递交相关申请材料。具体办理程序见本网站礼宾服务-证件办理一栏中相关规定。为新到任馆员申办身份证件时,需在照会中注明其接替的前任馆员(如有)姓名,职务及离任时间。离任馆员及其家属在交回身份证件后,使团办为继任者签发相关证件。3、身份证件的延期如身份证件即将到期但持有人仍需留任,请使馆在有关身份证件有效期满前1个月照会使团办,申请办理延期手续。过期证件不能办理延期。4、人员职衔的变动使馆常驻人员身份或职衔变更(如使馆行政技术人员被任命为外交人员)时,有关使馆或机构应在十日内照会外交部使团办,说明情况并申请为相关人员办理新身份证件。具体办理程序见本网站礼宾服务-证件办理一栏中相关规定5、身份证件的补发如遗失或损坏身份证件,有关使馆或机构应立即照会外交部使团办说明情况,申请补发或更换证件。具体办理程序见本网站礼宾服务-证件办理一栏中相关规定。6、身份证件的退回为不影响继任者领取身份证件,请使馆及时将离任人员及其家属的身份证件退回使团办。(二)居留登记有下列两种情况的人员如需在华停留,须由所在使馆或机构照会使团办申请居留登记:a. 持有效签证入境到使馆临时工作或探亲的人员(均须持有外交或公务护照)超过签证停留期的;b. 持外交或公务护照免签来华超过免签停留期限的。照会应注明申请人的身份,居留事由和拟在中国停留的时间,并随照附送申请人护照,并在“驻华外交机构及国际组织事务管理系统”中填报申请人相关信息。(三)北京首都国际机场隔离区证件1、专用通行证(1)大使(及配偶)专用机场通行证使馆为大使(及配偶) 申请办理专用机场通行证件,请提前15个工作日照会使团办提出书面申请。使馆凭使团办同意的复照并携带大使(及配偶)的1寸正面免冠彩色照片和前任大使(夫妇)的专用通行证(如有)前往首都机场公安分局证件科办理。使馆须在大使专用通行证有效期截止前2周内,向首都机场公安分局证件科申请换发,无需照会使团办申请。(2)其他外交人员专用通行证使馆申请为其他外交人员申请专用通行证,请提前15个工作日照会使团办提出书面申请。使馆凭使团办同意照会前往首都机场公安分局证件科办理。使馆最多可持有5个外交人员专用通行证,使团办将根据对等原则进行审批。使馆持有专用通行证的外交人员离任或其他原因不再使用专用通行证时,须将证件交还首都机场公安分局证件科注销。首都机场公安分局视证件注销情况及拥有数量决定是否换发或新发通行证。专用通行证换发可径向首都机场公安分局证件科申请,但需照会使团办备案。2、专用通行证遗失上述机场隔离区证件如有遗失,请使馆务必在24小时内书面通知首都机场公安分局证件科并向使团办备案。3、一次性通行证除申请专用通行证外,如工作需要,使馆人员可申请一次性通行证。一次性通行证限当日申请、当日当次使用。使馆需指定专人担任机场通行证事务联系人,并提前将使馆馆印、授权人签字、机场通行证事务联系人情况送首都机场公安分局证件科备案,并领取办理一次性通行证专用介绍信。办理一次性通行证时,相关外交人员须持专用介绍信、使馆照会、外交身份证前往相应航站楼办理。4、国际组织驻华代表机构参照上述办法办理上述通行证事宜。具体办证事宜可直接咨询首都机场公安分局证件科(电话:64564129)。三、使馆举办活动(一)国庆、建交招待会1、使馆举行国庆、建交等招待会的日期和具体时间确定后,请即书面通知使团办。2、使团办负责转送致国家领导人和外交部部领导的请柬。3、根据中方礼宾惯例,外交部主管副部长(或部长助理)作为中国政府代表出席。(二)义卖活动请使馆提前10个工作日向使团办发送举办义卖活动的照会。使团办将应使馆要求视情提供咨询和协助。(三)吊唁活动请使馆提前将举行吊唁活动的时间、地点照会使团办。使团办将视情安排中方代表参加。(四)文化交流活动使馆或其人员在馆外举办文化交流活动,请提前通知中方文化和影视主管部门。1、文化交流活动包括:使馆在馆外举办或联合举办双边文化交流计划外的文化活动,文化性质的庆祝、纪念、图书、艺术、新闻展览、征文等宣传活动、电影展映活动和与文化相关的研讨会、讲座、资助、捐赠、颁奖、授勋等活动、使馆人员以个人名义或以其他境外机构组织的名义举办的文化活动。2、上述活动请提前20个工作日书面告知中国文化部外联局。3、举办电影活动(含综合性文化活动中的电影展映),另请书面告知中国国家广播电影电视总局国际合作司。(五)教育交流活动1、使馆人员要求到中国学校参观访问、演讲、座谈、举办讲座,或参加中国高等院校主办的国际学术会议,请直接与校方联系。2、使馆商谈双边教育合作项目(开展合作办学,建立科研中心,资料中心,举办研讨会,捐资助学,授予学术职称,互派人员访问等),请与中国教育部国际合作与交流司联系。(六)在使馆设立投票箱或组织选民登记遇派遣国举行大选,使馆如需在馆内设立投票箱或组织在华选民登记,请提前将活动时间和方式照会使团办。中方不同意在馆外举办上述活动。四、免关税进出境物品(一)使馆和外交代表进出境物品使馆或外交代表以托运或邮寄方式运进运出公务用品或自用物品,应填写《中华人民共和国海关外交公/自用物品进出境申报单》,加盖使馆馆印,由馆长或馆长授权的外交代表签字,并附有关单证材料送北京海关办理报关手续。使馆和外交代表邮寄进出小包邮件,可免填该申报单。海关凭使馆的照会和中国外交部颁发的身份证件受理和审批。外交代表进出境时随身携带或附载于同一运输工具上的私人行李物品,应当口头向海关申报,海关予以免验放行(有关物品数量超过规定的限额,应当书面申报)。使馆申报运进的公务用品和外交代表申报运进的自用物品,经海关审核在直接需用数量范围内的,可免关税。海关有重大理由推定外交代表携运进出境自用物品装有规定免税范围以外的物品、中国政府禁止进出境或者检疫法规规定管制的物品的,有权查验。海关查验时,外交代表或其授权人员应当在场。海关不准进出境的物品,使馆和使馆人员应当在海关禁止进出境之日起3个月内办理相关物品的退运手续。(二)使馆行政技术人员和服务人员进出境物品使馆的行政技术人员和服务人员,如非中国公民或者在中国的永久居留者,携运进境自用物品,包括到任后半年内运进安家物品,应当书面向海关申报。上述物品经海关审核在直接需用数量范围内(其中汽车每户限一辆)的,海关予以查验免关税放行。申报携运出境的自用物品,海关予以审核查验放行。(三)免关税运进物品的转让免关税运进的物品,未经主管海关批准,不得转让。海关监管车辆等免关税运进的物品转让,应当按照规定向海关办理转让和完税手续。(四)公务用品和自用物品“公务用品”系指使馆执行职务直接需用的物品,包括家具,陈设品,办公用品,招待用品和机动车辆等;“自用物品”系指使馆人员及其配偶,未成年子女在中国居留期间直接需用的生活用品,包括家具,家用电器和机动车辆等。五、外交邮袋使馆交运或提取的外交邮袋须附有可资识别的外部标记,并以装载外交文件或公务用品为限。外交信使运送外交邮袋时,必须持有派遣国主管机关出具的信使证明书。商业飞机机长受委托可以为使馆转递外交邮袋,但必须持有委托国的官方证明文件,注明邮袋件数。托运或者由商业飞机机长转递的外交邮袋,应当由使馆派员办理提取或交运手续。押运人员(信使),提取或托运人员须遵守机场,车站和码头的管理规定,上述人员及其车辆不得进入机场停机坪,车站和码头的隔离区域。外交邮袋的重量和体积应是合理的,集装箱不得作为外交邮袋。外交邮袋每批次总重量不得超过1000公斤,单件重量不得超过100公斤,单件物体为任何边长不超过1米的立方体。超出此限量部分须作为使馆公务用品申报入关。对于以专(包)机,火车,轮船等方式运入或以托运方式运入的在此限量内的外交邮袋,卸载后须运入海关监管仓库,使馆向海关办理申报手续后方可提取。外交信使乘坐飞机,火车或轮船时随身携带外交邮袋的重量和体积须符合有关交通运输部门(公司)的规定。使馆须将外交邮袋的外部标记和外交信使证明书样本一式五份提交主管地海关备案。六、动植物检疫使馆运进或运出动植物,动植物产品以及其它检疫物,在进出境时须向口岸动植物检疫机关报检,并接受检疫。使馆人员携带伴侣动物入境,须在入境时提供伴侣动物的健康证明,检疫证书和有效防疫证明。使馆外交人员的私人行李按照中国有关规定免受查验,但对有重大理由推定其中装有“中华人民共和国进出境动植物检疫法”中规定禁止入境或须检疫合格方可入境的物品的,动植物检疫机关有权查验。查验时须有外交人员本人或其授权的人员在场。口岸动植物检疫机关可根据“中华人民共和国进出境动植物检疫法”,对使馆人员携带入境的属禁止入境或者经检验不合格的动植物,动植物产品以及其它检疫物做除害,退回或者销毁处理。七、增值税退税(一)可享受退税待遇的机构和人员外国驻华使(领)馆及其外交代表(领事官员)和非中国公民且不在中国永久居留的行政技术人员在华购买的物品和劳务,中国政府在对等原则的基础上,予以退还增值税。(二)可退增值税的物品及劳务“中华人民共和国增值税暂行条例”规定的属于增值税征收范围,按现行规定征收增值税,且单张发票金额合计等于或高于800元人民币的物品及劳务。申报退税的自来水,电,生活用燃气,暖气的发票和修理修配劳务的发票无最低限额要求。(三)申报退税的物品,劳务价格明显偏高,数量明显偏多,且又无正当理由的,不予退税。(四)退税办理办法参照《外国驻华使(领)馆及其人员在华购买物品和劳务退还增值税管理办法》【2003礼字第57号】(五)机动车燃油的增值税退税方式请参考“车辆及交通”一章“免增值税加油”部分。八、车辆及交通(一)机动车辆管理1、机动车辆获得或转让驻华使馆进口公用车辆和外交代表进口自用车辆总数均应以不超过该使馆外交代表总数为限,其自用车辆限每人1辆;使馆行政技术人员和服务人员(需为非中国公民且不在中国永久居留),可在到任后6个月内免税进口自用车辆,每户限1辆。各使馆应在进口车辆之前向北京海关了解有关车辆配额情况。离任回国的使馆人员应当在离境前向主管海关办理自用车辆结案手续。在办理机动车辆入,出境或转让手续后,使馆人员须通过互联网登录“驻华外交机构及国际组织事务管理系统”,及时填写车辆详细信息并提交有关纸质材料,否则使馆或使馆人员使用的相关转让车辆将无法享受专用免税燃油待遇。2、免增值税加油使馆车辆可在中石化或中石油所属的北京地区加油站点进行免增值税加油,具体操作程序如下:在“驻华外交机构及国际组织事务管理系统”中按要求完成车辆的在线注册并提交有关纸质材料,待使团办审核同意后,可前往中石化或中石油指定的免税加油卡销售点购买免税加油卡并进行充值。加油时,在每季度免税额度内的直接免除增值税,超出部分按正常含税价格收费。(二)申办和换领机动车驾驶证中方按对等原则为使馆人员办理中国机动车驾驶证。具体事宜请到北京市公安局公安交通管理局车管所外事科办理,地址:北京市朝阳区南四环东路十八号(南四环十八里店南桥西南角车管所院内东侧),电话:87625150。北京市公安局公安交通管理局网址:www.bjjtgl.gov.cn(三)交通违章和事故处理1、使馆人员有义务尊重中国法律、规章,应遵守“中华人民共和国道路交通安全法”。使馆人员应按规定为车辆投保交通事故责任强制保险并定期检验车辆。如发生违章行为,使馆人员应按中国有关规定接受处罚。2、发生交通事故后,请及时拨打交通事故报警电话“122”,配合交管部门维持现场,主动出示有关证件,做好事故责任认定工作。3、如事故中发生人员伤亡,请立即拨打急救电话“120”或“999”。4、事故后,请及时通知有关保险公司,做好理赔工作,并与交管部门保持联系。(北京市公安局公安交通管理局事故处电话:68398203)5、交管部门是中国官方裁定交通事故的权威部门,交管部门依法作出的裁定即为有效裁定。如事故双方在赔偿,事故处理方面发生争议,请在交管部门出具事故责任认定书后10日内申请调解,交管部门在事故双方均同意调解的前提下进行调解,对调解持异议时,可循司法途径解决。九、旅 行(一)前往外地旅行使馆人员及其家属前往外地旅行时请随身携带有效身份证件。不得进入设有“未经许可不得超越”标记的地区。使馆人员如希会见地方政府负责人,与地方有关部门举行座谈等,请提前10个工作日照会有关省,自治区,直辖市人民政府外事办公室。使馆人员及其家属前往西藏旅行,应至少提前15个工作日向自治区外办提出申请。获准后,自治区外办将负责安排申请人在西藏的活动。(二)乘用交通工具使馆人员及其家属前往外地旅行,除北京-天津公路,北京-天津-北戴河公路(限每年6月1日至9月30日避暑季节)可乘自备车外,请乘用公共交通工具。十、通讯业务(一)关于互联网接入、普通电话安装业务,可径商运营商办理,无需经外交部使团办审批。(二)申请进口和使用无线电设备、使用无线电频率、设立无线电通讯网络、申请数据专线接入,进口和安装海事卫星、设立卫星通讯地球站(VSAT)接收天线及附属设备等均需向外交部使团办提出申请。使团办在对等原则基础上进行审批。十一、枪支管理(一)办理枪支,弹药的入境手续1、使馆及其人员携带枪支、弹药入境,须提前15个工作日照会使团办提出申请(一式两份),详细说明拟运入境的枪支、弹药的种类、名称、型号、数量及其编号。2、凭使团办同意的复照前往入境口岸边防检查站办理枪支登记,领取“枪支(弹药)携运许可证”。3、海关凭“枪支(弹药)携运许可证”放行。4、入境后15天内,持使团办复照和“枪支(弹药)携运许可证”到当地市级公安局办理备案登记手续,填写“各国驻华外交代表机构及其人员持有枪支备案登记表”(一式两份,自留一份)。(二)办理枪支,弹药的出境手续1、使馆及其人员拥有或携带的枪支、弹药出境,须提前5个工作日向使团办提出申请(一式两份),详细说明拟运出境的枪支、弹药的种类、名称、型号、数量及其编号。2、持使团办同意的复照前往出境地海关,边防检查站申报登记。(三)枪支,弹药的保存经使团办批准运入的枪支、弹药,须存放在使馆或大使官邸,严禁携出馆舍。 十二、学 习使馆人员到高校学习,进修汉语一年以内(含一年),由使馆照会使团办及所在学校,申明其在校期间放弃外交特权与豁免,并遵守学校规定。申请人员无需改换护照、签证种类和所持身份证件。使馆人员随任配偶在中国高等学校学习,可径向有关高等学校提出入学申请,并保留依法享有的外交特权与豁免待遇,无需改换护照、签证种类和所持身份证件。使馆人员的成年子女到高校学习,应在入学前照会使团办提出申请,并出具有关高校录取通知书和“外国留学人员来华签证申请表”,退回“居留许可证”,改持普通护照,将其原签证交领事司注销,并到当地公安机关申办学习(X)签证并办理其他相关手续。十三、配偶任职(一)配偶申请任职所须办理的手续使馆人员的配偶申请任职,应由其所属使馆照会使团办,申明放弃拟受聘(受雇)者在华享有的外交特权与豁免,退回使团办签发的身份证件,将护照送领事司注销签证。(二)配偶任职申请获批准后须办理的手续任职申请获准后,受聘(受雇)者须持中方聘用部门同意任职的文件影印件及普通护照,在中国境外申请工作签证,入境后到当地公安部门办理居留手续。受聘(受雇)者就职后应当遵照中国税法规定,向当地税务机关办理纳税登记手续,依法纳税。受聘(受雇)者如系外交代表的配偶,其姓名不再登入“外交官名册”。 十四、国宾和重要外宾访华由外交部接待的国宾和重要外宾访华前,请来访国使馆向礼宾司书面提供以下资料:(一)供发表用的来访国国宾及随访配偶的简历。如系国事或正式访问,请提供供发表的国宾照片,如国宾系国王,请同时提供随访配偶照片。(二)来访国国旗(元首旗或国王旗)旗样(附制作和使用说明)、国歌乐谱(最好是军乐谱或钢琴谱)、国歌DVD或CD唱盘(附国歌内容说明)、民歌、民乐乐谱(附DVD或CD唱盘并注明曲名)。(三)来访国国宾和重要外宾(夫妇)的生活习惯、饮食禁忌、鲜花禁忌及血型。(四)来访国国宾和重要外宾抵、离华的时间、路线、交通工具及具体航班号(车次)。(五)专机申请。至少在国宾和重要外宾抵华前10个工作日以照会形式提出。申请内容应包括飞机注册国、飞行目的、机型、飞机标识(包括国别标识和注册标识等)、飞机呼号、飞机上无线电通讯设备使用频率;往返飞行路线、日期、时间及在中国境内飞行路线;机组人员姓名、职务和国籍。经中方有关部门同意,由礼宾司答复并提供中方批准号后,专机方可入境飞行。专机机组接待由来访国负责。专机和专机机组在中国境内一切业务费用自理(互免情况除外)。(六)武器申请。至少在国宾和重要外宾抵华前5个工作日以照会形式提出。申请内容包括:携带武器者姓名、枪型、枪号、口径、子弹数量。(七)无线报话机使用申请。至少在国宾和重要外宾抵华前20个工作日以照会形式提出。申请内容包括设备名称、牌号、型号、数量、频率范围、使用频道、发射功率、发射类别、工作种类、调制方式、配备何种天线及天线的特征和高度、呼号(或代号)、使用地点、使用目的(安全、新闻、各住地间联络)和使用时间,待中方有关部门批准后方可使用。 Arrival in Beijing (1) The diplomatic mission is requested to advise the Protocol Department in writing one week in advance of the arrival time, flight (or train) number and the number of people accompanying the ambassador.  (2) The ambassador will be met by a representative of the Protocol Department at the airport (or railway station). A VIP lounge will be provided and customs inspection will be exempted. (3) The diplomatic mission is expected to make arrangements for local transportation and residence. 2. Presentation of the Copy of Credentials A senior official of the Protocol Department will receive the copy of credentials on the appointment of the new ambassador and the copy of credentials of the recall of the former ambassador and brief the ambassador on the procedures of presenting credentials and related matters. After the date and specific time of presenting credentials are set, the Protocol Department will notify the diplomatic mission of related arrangements. 3. Presentation of Credentials The Ministry of Foreign Affairs will provide a protocol car for the ambassador to present credentials. It is expected that the accompanying diplomats will take cars of the diplomatic mission. Dress code: National dress, suit or formal attire. 4. Courtesy Call (1) Premier of the State Council will meet outgoing and incoming ambassadors, usually in groups on a non-regular basis. No courtesy call on other state leaders will be arranged. (2) The foreign minister will meet with the ambassador. If the ambassador wishes to call on officials of other government departments, the diplomatic mission may contact them directly.(II) DepartureDate of DepartureThe diplomatic mission should inform the Protocol Department of the date of departure of the ambassador in writing as early as possible. Farewell Call (1) Premier of the State Council will meet outgoing and incoming ambassadors, usually in groups on a non-regular basis. No farewell call on other state leaders will be arranged. (2) The foreign minister or another senior official of the Foreign Ministry will meet with the ambassador. If the ambassador wishes to pay farewell calls on officials of other government departments, the diplomatic mission may contact them directly.Farewell Dinner A competent vice (or Assistant) foreign minister will hold a farewell dinner for the ambassador. Departure from Beijing (1) The diplomatic mission should inform the Protocol Department of the departure date, specific time, flight (or train) number and the number of accompanying persons in writing as early as possible. (2) The ambassador will be seen off by a representative of the Protocol Department at the airport (or railway station). Application for Certificates(I) Identity Certificates  A member of the diplomatic mission and his/her family members who have arrived in China should apply for corresponding certificates of identity from the Protocol Department as soon as possible, carry the certificates when leaving the mission and present them when the military, police, check post or relevant authorities require. 1. Types of Certificate of Identity “Diplomatic Identity Card” is issued to diplomats of diplomatic missions in China and members of the offices of international organizations with diplomatic status as well as their spouses. “Identity Card” is issued to the administrative, technical and service staff members of diplomatic missions and corresponding members of the offices of international organizations in China as well as their spouses. “Residence Permit” is issued to minor children accompanying the members of diplomatic missions and the offices of international organizations in China. (below 18 years old and holding their own passports, excluding foreign students in China and those married.) “Residence Card” is issued to adult children (at or above 18 years old), parents, parents-in-law and non-immediate relatives of the members of diplomatic missions and the offices of international organizations in China.ApplicationDiplomatic missions should send notes verbale to the Protocol Department to apply for applicable certificates of identity for any new member and his/her family members according to his/her post or status within one week of their arrival in Beijing. His/her passport, four 3cm×2.4cm bareheaded, full-faced and color ID photos and a filled-in Application Form of ID Card or Application Form of Residence Card in duplicate should be enclosed in the note. To apply for “Residence Permit”, the names and the numbers of the certificates of identity of the parents of the applicant should be provided. If the children use the same passport with their parent, there is no need to apply for such cards. When applying for certificates of identity for a new member, the diplomatic mission should specify the name, post and departure time of his/her predecessor in the note. Only after receiving the certificates of identity returned by the predecessor and his/her family members will the Protocol Department issue the certificate of identity to the successorApplication for Extension If a certificate of identity is due to expire soon but its holder needs to stay at the post, the diplomatic mission should send a note verbale about one month before the expiry date to the Protocol Department to apply for its extension. No extension will be given to an expired certificate.Change of Status If a certificate holder’s status is changed, he/she (and his/her family members) needs to apply for a new certificate of identity. The diplomatic mission should send to the Protocol Department within a week of change of status a note verbale with the holder’s passport, original certificate of identity (and those of his/her family members) as well as two 3cm×2.4cm, bareheaded, full-faced and color photos for each applicant enclosed. If a person’s status is changed from an administrative or technical staff member to a diplomat, the original passport, the newly issued diplomatic passport, two registration forms with photos, two photos and the original certificate of identity should be enclosed in the note. Reissuance of Certificate of Identity If a certificate of identity is lost, the diplomatic mission should file a loss report to the local public security authorities and send a note verbale to the Protocol Department to apply for a new one. The note should contain the original loss report and two photos of the applicant.Return of Certificate of Identity The diplomatic mission should return the certificate of identity of a departing member (and his/her family members) to the Protocol Department in time to facilitate the application for certificate of identity by his/her successor. For further information, please contact the Office of ID Card & Travel Permit of the Protocol Department.(II) Residence Registration If a diplomatic/service passport holder who comes to China with visa exemption to work temporarily at the diplomatic mission or to visit family intends to stay for more than 30 days in China, the diplomatic mission should send a note verbale with the passport of the applicant enclosed to the Protocol Department within 10 working days of his/her arrival in Beijing to complete “Residence Registration” formalities. The note should specify the applicant’s status, ground for staying and the duration of stay in China. If the aforementioned person comes to China with a visa valid for a specific period of time, there is no need for him/her to complete residence registration formalities within the valid period. For further information, please contact the Office of ID Card & Travel Permit of the Protocol Department.(III) Access Cards to Restricted Areas of the Beijing Capital Airport1.Special Access Cards to airport restricted areas(1)Special Access Cards to airport restricted areas for ambassador (and his/her spouse) To apply for the Special Cards to airport restricted areas for ambassador (and his/her spouse), the diplomatic mission should send a note verbale (two copies) to the Protocol Department 15 working days in advance. After receiving the reply note of approval of the Protocol Department, the diplomatic mission may take it and a 3cm×2.4cm bareheaded and full-faced color ID photo of the ambassador (and his/her spouse) to the Section of Document of the Beijing Capital Airport Police Bureau to obtain the Access Card(s) (Tel: 64564129).When the Access Cards for ambassador (and hie/her spouse) expire, the diplomatic mission, no need of sending a note verbale to the Protocol Department, should apply to the Section of Document of the Beijing Capital Airport Police Bureau to renew the cards within two weeks before expiration. (2) General Access Cards to airport restricted areas To apply for the General Access Cards to airport restricted areas, the diplomatic mission should send a note verbale (two copies) to the Protocol Department 15 working days in advance..  The diplomatic mission may take the reply note of the Protocol Department to the Section of Document of the Beijing Capital Airport Police Bureau to obtain the Access Card.Every diplomatic mission may have five General Access Cards at most. The Protocol Department will approve based on the principle of reciprocity. When members of the diplomatic mission with General Access Card under his/her name does not use the General Access Card any longer for leaving his/her position or other reasons, he/she should return the card to the Section of Document of the Beijing Capital Airport Police Bureau. The Section of Document will decide whether to renew or issue new cards according to the situation of returned cards and current number of access cards held by the diplomatic mission.Diplomatic missions can apply to the Section of Document of the Beijing Capital Airport Police Bureau to renew the cards and send a note verbale to the Protocol Department for reference. (3) Loss of Access CardsIf an access card is lost, the diplomatic mission must inform the Section of Document of the Beijing Capital Airport Police Bureau in writing within 24 hours and notify the Protocol Department.2.One-off Pass to airport restricted areasIn case of working need, members of the diplomatic mission can apply for One-off Passes to airport restricted areas. The One-off Passes can be used only once on the date of application.The diplomatic mission should appoint a certain person to take charge of the passes to airport restricted areas. The samples of the stamp of the diplomatic mission, the signature of the authorized person and personal information of the person in charge should be sent to the Section of Document of the Beijing Capital Airport Police Bureau for reference, and the diplomatic mission can get the special letters of introduction for applying for One-off Passes.The relevant members of the diplomatic mission should take the special letter of introduction, a note verbale, diplomatic ID cards to the relevant terminal of the airport to apply for One-off Passes.For more details of applying for access cards and passes, please contact the Section of Document of the Beijing Capital Airport Police Bureau (Tel: 64564129).For further information, please contact the Division of Diplomatic Privileges & Immunities of the Protocol Department.III. Diplomatic Functions (I) Receptions to Mark National Day or the Establishment of Diplomatic Relations with China 1. Diplomatic missions are requested to inform the Protocol Department through note verbale of the date and time of the receptions to mark national day or the establishment of diplomatic relations with China. 2. The Protocol Department will forward invitations to Chinese state leaders and leading officials of the Ministry of Foreign Affairs. 3. According to protocol practices in China, a vice minister or an assistant minister of the Ministry of Foreign Affairs will attend such receptions on behalf of the Chinese Government. For further information, please contact the Office of Asian & African Affairs and the Office of European, American & Oceanian Affairs of the Protocol Department.(II) Charity Sales Diplomatic missions are requested to inform the Protocol Department through note verbale 10 working days before charity sales. If requested by the missions, the Protocol Department will, as necessary, provide relevant information.  For further information, please contact the Office of Asian & African Affairs and the Office of European, American & Oceanian Affairs of the Protocol Department.(III) Paying Condolences Diplomatic missions are requested to inform the Protocol Department in advance of the place and time for paying condolences. The Protocol Department will arrange for government representatives to pay condolences. For further information, please contact the Office of Asian & African Affairs and the Office of European, American & Oceanian Affairs of the Protocol Department.(IV) Cultural Events Diplomatic missions or their members need to notify the Chinese government departments in charge of cultural, film and television affairs in advance if they are going to organize cultural events outside diplomatic premises. 1. Cultural events include: cultural activities not covered by bilateral cultural exchange programs sponsored or co-sponsored by diplomatic missions outside their premises, such as cultural activities of celebration or commemoration, book exhibition, art performance, media exhibition, writing contest and film festivals as well as seminars, lectures, donation, award-giving and order awarding, and other cultural activities organized by members of diplomatic missions in their own name or on behalf of overseas institutions and organizations. 2. To organize the aforementioned events, diplomatic missions should notify the Bureau for External Cultural Relations of the Ministry of Culture of the People’s Republic of China in writing 20 working days in advance. 3. To show films (including films shown as part of a cultural event), missions should inform the International Cooperation Department of the State Administration of Radio, Film and Television in writing.(V) Educational Exchanges 1. If members of diplomatic missions plan to visit, give lectures or speeches, and have discussions at Chinese schools or attend international seminars sponsored by institutes of higher learning in China, they may contact the schools or institutes directly. 2. If diplomatic missions need to discuss with the Chinese side about bilateral education cooperation projects (such as joint running of schools, joint establishment of scientific research centers and information centers, seminars, donation and financial aid to educational projects, conferment of academic titles and mutual visits), they may contact the Department of International Cooperation and Exchange of the Ministry of Education.(VI) Setting Ballot Boxes and Organizing Voter Registration on the Premises of Diplomatic Missions If diplomatic missions need to set ballot boxes on their premises or organize voter registration for general elections in the sending states, they should notify the Protocol Department of the time and procedure of the voting activities. For further information, please contact the Office of Asian & African Affairs and the Office of European, American & Oceanian Affairs of the Protocol Department.IV. Exemption of Customs DutiesArticles imported or exported by diplomatic missions or their diplomatic agents For diplomatic mission or their diplomatic agents to import or export articles for official or private use by consignment or postal service, the Declaration Form of Articles for Official or Private Use Imported or Exported by Foreign Diplomatic and Consular Missions (in three copies) should be completed, affixed with the official seal of the mission, the signature of the head of the mission or authorized diplomatic agent and submitted with the list of articles and invoices to the Beijing Customs for clearance. Diplomatic missions and their diplomatic agents do not need to fill out the declaration form when they import or export articles in small packages through postal service. The Beijing Customs will screen and approve the import or export of the packages upon receiving a note verbale from the diplomatic mission and presentation of the identity certificate of the individual concerned issued by the Ministry of Foreign Affairs.  Diplomatic agents of the missions should declare orally to the customs their carry-on baggage or articles for private use shipped by the same means of transport they use. The customs will clear them without inspection (or follow the procedure set out in the applicable bilateral agreement). If there is serious ground to believe that the baggage contains articles not for official or private use or are prohibited from import and export by Chinese laws and regulations, the customs has the right to inspect the baggage. The inspection should be conducted in the presence of the diplomatic agent concerned or his or her authorized representative. Articles imported by diplomatic missions declared for official use and those imported by diplomatic agents declared for private use are exempt from customs duties if the customs has determined that the quantity of the articles is within the reasonable limit for direct use by the missions or diplomatic agents.  If diplomatic missions or their staff wish to repatriate articles which are prohibited by the customs for import or export, they need to fill out the Certificate for the Repatriation of Imported or Exported Goods and complete the repatriation formalities within 90 days of the articles’ entry into China.Articles imported or exported by administrative, technical or service staff of diplomatic mission.  The administrative, technical or service staff of diplomatic missions who are not Chinese citizens or permanent residents in China should make written declarations to the customs for articles for private use to be brought or shipped into China, including articles for household use which are imported within six months of taking the post. These articles will be cleared with duties exempted by the customs after its inspection shows that the quantity of the goods is within the reasonable limit for direct use by persons concerned (one car for one family). Articles for private use to be taken or shipped out of China will be cleared by the customs after inspection.Transfer of imported articles that are exempted from customs duties Imported articles that are exempted from customs duties are not transferable. Prior permission must be obtained from the customs if such transfer is needed due to special reason. In this case, the Application Form for the Transfer of Ownership of Articles for Official or Private Use of the Diplomatic and Consular Missions (in three copies) must be completed and presented to the Beijing Customs. When the transfer is approved, the recipient or transferor should complete formalities for paying customs duties in accordance with relevant regulations.(IV) Definition of articles for official use and private use “Articles for official use” refer to articles used by diplomatic missions in performing official functions, including furniture, ornaments, office equipment, supplies for reception activities and motor vehicles. “Articles for private use” refer to articles for daily use by members of the missions, their spouses and minor children accompanying them during their stay in China, including furniture, household electrical appliances and motor vehicles.  For further information, please contact the Office of Diplomatic Privileges and Immunities of the Protocol Department.V. Diplomatic Bags Incoming and outgoing diplomatic bags must be clearly marked on the exterior and only used for delivering diplomatic documents or articles for official use. Diplomatic couriers must hold proper papers issued by the competent authorities of the sending state. The captain of a commercial aircraft, entrusted by a diplomatic mission, may deliver diplomatic bags, but he must hold official papers from the consigner country indicating the number of bags. To send diplomatic bags through consignment shipping or through the captain of a commercial aircraft, diplomatic missions should send their staff to complete the procedures for delivery or dispatch. Those responsible for escorting diplomatic bags (diplomatic couriers), and those for their collection and consignment shipping should respect the regulations of airports, railway stations and ports, and should not enter the restricted areas of airport aprons, railway stations and ports.  The weight and size of a diplomatic bag should be reasonable. Container should not be used as a diploqmatic bag. The total weight of each batch of diplomatic bags must not exceed 1,000 kilograms and each bag must not exceed 100 kilograms. The cubic space of a diplomatic bag should not exceed 1000mmⅹ1000mmⅹ1000mm. The part in excess must be declared for entry as articles for official use for diplomatic missions. The diplomatic bags of acceptable weight and size carried by a special plane or chartered plane or transported by railway, ships or other means, or consignment shipping should be placed in a customs-supervised warehouse after being unloaded and may be picked up after relevant declaration procedures are completed by diplomatic missions. The weight and size of carry-on diplomatic bags should meet the requirements of air, railway or shipping authorities (companies). Diplomatic missions should provide five copies of the mark on the exterior of diplomatic bags and samples of their courier identification papers to the competent customs authorities for the record. For further information, please contact the Office of Diplomatic Privileges and Immunities of the Protocol Department. VI. Quarantine of Animals and Plants To import or export animals, plants, related products or other items subject to quarantine inspection, diplomatic missions must declare them to the quarantine authorities for inspection at ports of entry or exit. Members of diplomatic missions who intend to bring pets into China should present, upon entry, the pets’ health and quarantine certificates and valid immunization records. Personal baggage of diplomats accredited to China is exempt from inspection according to relevant regulations in China. However, when there are serious grounds for believing that the baggage may contain items which are prohibited from entry or need quarantine clearance under the Law of the People’s Republic of China on the Entry and Exit Animal and Plant Quarantine, the quarantine authorities have the right to carry out inspection on it. Such inspection will take place in the presence of diplomats concerned or their representatives. In accordance with the Law of the People’s Republic of China on the Entry and Exit Animal and Plant Quarantine, the quarantine authorities may disinfect, return or destroy animals, plants, related products or other items subject to quarantine brought in by members of diplomatic missions which are prohibited from entry or have failed to pass quarantine inspection.  For further information, please contact the Office of Asian & African Affairs and the Office of European, American & Oceanian Affairs of the Protocol Department. VII. Refund of Value-Added Tax (VAT) (I) Organizations and individuals eligible for VAT refund On the basis of reciprocity, the Chinese Government accepts claims of VAT refund by diplomatic missions, diplomatic agents and administrative and technical staff of diplomatic missions who are neither citizens nor permanent residents of China on goods and services they have purchased in China.  (II) Goods and services covered by VAT refund Refund may be claimed on goods and services on which VAT is levied in accordance with the Provisional Regulations of the People’s Republic of China on Value-Added Tax and when the amount of a single invoice is no less than RMB800. However, there is no minimum amount requirement for invoices for tap water, electricity, gas for daily use, heating and repair services. (III) Claims for VAT refund will not be accepted if the prices are too high or the quantities of the purchase are too large without justifiable explanation.  (IV) For procedures for VAT refund on fuel for motor vehicles, refer to “Exemption of VAT on Fuel” in the Chapter of “Motor Vehicles and Driving in China”. For further information, please contact the Office of Diplomatic Privileges and Immunities of the Protocol Department.VIII. Motor Vehicles and Driving in China(I) Motor Vehicles 1. Import, export and transfer of motor vehicles A diplomatic agent may import one vehicle for private use during his/her term of office in China. The administrative and technical staff of diplomatic missions may import one motor vehicle per household for private use within the first six months of their term of office in China.  To import, export or transfer motor vehicles for official or private use, diplomatic missions should inform the Protocol Department and the Beijing Customs in notes verbale in advance.  At the end of tour of duty, members of diplomatic missions should, before departure, complete customs formalities for disposing of vehicles for private use. Upon completion of procedures for the import, export or transfer of motor vehicles, members of diplomatic missions should log on to the “Vehicle Administration System of Foreign Diplomatic Missions in China” (webpage: http://protocol.fmprc.gov.cn) and fill in forms with detailed information on vehicles. Otherwise, the transferred vehicles used by diplomatic missions or their members will not be regarded as diplomatic vehicles and will not be entitled to diplomatic privileges or immunities. 2. Exemption of VAT on fuel Members of diplomatic missions are entitled to purchasing VAT-free fuel for their vehicles at service stations of China National Petroleum Corporation and China Petroleum and Chemical Corporation in Beijing. The procedures are as follows: Complete online vehicle registration as required at the webpage of “Vehicle Administration System of Foreign Diplomatic Missions in China” (http://protocol.fmprc.gov.cn) and, upon approval of the Protocol Department, purchase cards for VAT-free fuel at outlets designated by the two afore-mentioned companies and charge the cards with money. At the time of fuelling, the VAT of the purchased petrol will be exempted as long as it is within the quarterly VAT-free quota, but the amount that exceeds the quota will be charged at normal VAT-inclusive price. For further information, please contact the Office of Diplomatic Privileges and Immunities of the Protocol Department.(II) Driver’s Licenses Chinese driver’s licenses for motor vehicles are issued to members of diplomatic missions on the basis of diplomatic reciprocity.  To apply for driver’s licenses, please contact the Foreign Affairs Section of the Vehicles Administration Division of the Beijing Traffic Management Bureau at No.18, Nan Si Huan Dong Lu, Chaoyang District, Beijing. Members of diplomatic missions have the obligation to respect China’s laws and regulations and should comply with the Law of the People’s Republic of China on Road Traffic Safety. They must have compulsory traffic accident liability insurance for their motor vehicles which should go through annual inspection as required. In case of traffic violations, the members of diplomatic missions concerned should pay fines set out in relevant Chinese regulations. 2. In case of a traffic accident, please dial “122” immediately to report the accident to traffic police, assist the traffic authorities in keeping the scene of the accident intact and present relevant papers to help the police determine liability for the accident.  3. In case of casualties, please dial “120” or “999” immediately for first aid. 4. After the accident, please promptly inform insurance company concerned for compensation claim and keep in touch with the traffic authorities. (Division of Accident Handling of the Beijing Traffic Management Bureau: 68398203.)  5. The ruling made in accordance with the law by the traffic authorities is valid, as they are the competent authorities. If there are disputes between the parties involved over compensation and accident handling, please apply for mediation within 10 days after the accident liability report is issued by the traffic authorities. Mediation will be carried out by the traffic authorities on condition that it is agreed by both sides. Travel(I) Travel to other places When traveling to other places in China, members of diplomatic missions (and their families) are required to bring with them valid identification certificates. They should not enter areas marked as “Off limits for visitors without permission”. If members of diplomatic missions wish to call on leading officials of local governments or hold discussions with departments of local governments, they should send notes verbale to the foreign affairs offices in relevant provinces, autonomous regions and municipalities directly under the central government 10 working days in advance.  Members of diplomatic missions and their families who intend to visit the Tibetan Autonomous Region should apply to the Foreign Affairs Office of the Tibetan Autonomous Region at least 15 working days in advance. After their applications are approved, the Foreign Affairs Office of the Tibetan Autonomous Region will make arrangements for their activities in Tibet.(II) Means of transport Members of diplomatic missions and their families are required to use public transportation when traveling to other places. They may use their own motor vehicles when traveling on the Beijing-Tianjin Highway and Beijing-Tianjin-Beidaihe Highway (during the summer season between 1 June and 30 September). For further information, please contact the Office of ID Card and Travel Permit of the Protocol DepartmenX. Telecommunications Service1. For Internet access or fixed-line telephone installation, diplomatic missions, no need of approval of the Procotol Department, may directly contact the telecommunications operators.2. For importing and using radio equipment, using radio channels, setting radio communication network, international or domestic private leased circuits, importing and installing VSAT antenna and equipment, the diplomatic missions should apply to the Protocol Department. According to the Regulations of the People's Republic of China concerning Diplomatic Privileges and Immunities, the Procotol Department approve the application based on the principle of reciprocity (The application of consulates will be approved by the Department of Consular Affairs).3. Applying for importing, installing and using the above-mentioned telecommunication equipment, the diplomatic missions should log on the website of the Ministry of Foreign Affairs-Protocol Service-Telecommunication Equipment Declaration and Approval Management System to fill in relevant forms and and send a note verbale, together with the application forms, to the Protocol Department. The dimplomatic missions should take the reply note of the Protocol Department to finish the declaration and installation.4. Firearms Control(I) Entry procedures for firearms and ammunition 1. Members of diplomatic missions who intend to bring firearms and ammunition into China should file application (in duplicate) 15 working days in advance to the Protocol Department, specifying the type, name, model, quantity and serial number of the firearms and ammunition. 2. Upon receiving reply note of approval from the Protocol Department, members of diplomatic missions may register the firearms and ammunition and obtain a Permit for the Possession and Transportation of Firearms and Ammunition at the inspection station of the port of entry. 3. The firearms and ammunition will be cleared by the customs upon presentation of the Permit for the Possession and Transportation of Firearms and Ammunition. 4. Holder of the firearms should complete the registration procedure at the local municipal public security bureau within 15 days of entry by presenting the reply note from the Protocol Department and the Permit for the Possession and Transportation of Firearms and Ammunition and filling out the Registration Form of Firearms Possessed by Diplomatic Missions in China and Their Staff (in duplicate, with one copy of the Form for self keeping).(II) Exit procedures for firearms and ammunition 1. Diplomatic missions and their staff wishing to take firearms and ammunition out of China should file applications (in duplicate) to the Protocol Department 5 working days in advance, specifying the type, name, model, quantity and serial number of the firearms and ammunition they wish to take out of China. 2. Holder of the firearms should register the firearms and ammunition at the customs and border inspection station at port of exit by presenting the reply note of approval from the Protocol Department.(III) Storage of firearms and ammunition Firearms and ammunition brought into China with permission of the Protocol Department must be stored at the Embassy or the ambassador’s official residence. StudyIf members of diplomatic missions wish to study at institutes of higher learning or attend Chinese language courses for a period of no more than one year, diplomatic missions should send notes verbale to the Protocol Department and the schools where they wish to study to state that they will waive diplomatic privileges and immunities and abide by school regulations during their studies. Applicants are not required to change the type of their passports, visas or ID cards.If the spouses of members of diplomatic missions wish to study at institutes of higher learning, they may apply directly to the schools where they wish to study. Applicants may keep the diplomatic privileges and immunities they enjoy and are not required to change the type of their passports, visas or ID cards.If the adult children of members of diplomatic missions wish to study at regular institutes of higher learning, diplomatic missions need to send notes verbale of application to the Protocol Department before enrollment, attached with offer letters from the institutes concerned and Visa Application for Study in China. The applicants should return their Residence Cards, have their passports changed into ordinary passports, and have their original visas cancelled by the Department of Consular Affairs. Spouse Employment(I) Procedures for spouses to apply for employment If the spouse of a member of a diplomatic mission wishes to apply for a job, the mission should send a note verbale to the Protocol Department, stating waiver of privileges and immunities enjoyed by the spouse in China. The spouse should return his or her certificate of identity issued by the Protocol Department and bring his or her passport to the Consular Department to have the original visa canceled.(II) Procedures to be completed after application for employment is approved After the application for employment is approved, the spouse should apply for a working visa outside the Chinese territory with a photocopy of the job offer of the Chinese employer and his or her passport. The spouse should complete the formalities for residence at the local public security bureau after entering China. Once employed, the spouse should register with local tax bureau and pay taxes in accordance with the Chinese law. Visits to China by State Guests and Foreign VIPs Before visits to China by state guests and VIPs arranged by the Ministry of Foreign Affairs, diplomatic missions should provide the following information in writing to the Protocol Department:  (I) Biographical notes of the visiting state guests and their accompanying spouses for press release. For state or official visit, photos of the state guests for press release are required. For visit by King or Queen, photos of the accompanying spouses are also required. (II) Sample of national flag (flag of the head of state or flag of the king with instruction on how to make and use the sample), music score of the national anthem (military or piano music score preferred), DVD or CD of the national anthem (with the lines of the anthem attached), folk song, folk music score (with DVD or CD and the name of the music attached). (III) Habits, customs, dietary requirement, flower dislikes and blood types of the visiting state guests as well as VIPs and their spouses. (IV) Time of arrival and departure, travel route, means of transport and specific flight number or train number of the visiting state guests and VIPs. (V) Application for special plane flight clearance. Application for special plane flight clearance for state guests and VIPs should be filed no less than 10 working days before the flight. The application should include the following information: country of registration of the aircraft, purpose of flight, type of the aircraft, identification marks (including nationality and registration marks) of the aircraft, call signs of the radiotelephony, frequency range to be used by the radio station on the aircraft, the air route for the flight within the territory of China, dates and hours of the flight, and name, position and nationality of each crew member. The special plane is allowed to enter China’s territory only after approval by the competent Chinese authorities is granted and after a reply and an approval number are given by the Protocol Department. Reception of the crew members of the special plane should be the responsibility of the visiting country. All the expenses of special plane and its crew members in the Chinese territory should be borne by the visiting country (unless there is an agreement on mutual exemption).  (VI) Application for firearms. Such application should be filed at least 5 working days before the arrival of the state guests and VIPs. The application should include the following information: name of the bearer, type, serial number, and caliber of the firearm and the quantity of bullets.  (VII) Application for the use of walkie-talkies. Such application should be filed at least 20 working days before the arrival of the state guests and VIPs. The following information should be included in the application: name of equipment, trade mark, model, quantity, frequency range, operating frequencies, transmission power, type of emission, mode of operation and modulation, type, specification and height of antenna, call sign, location and purpose of operation (security, news coverage, or communication between places of accommodation), and duration and time of operation.   • 外交代表,又称外交使节,是一个国家派往其他国家或国际组织的代表。代表国家,负责办理外交事务,有常驻和临时两种。常驻外交代表系指派驻某一特定国家或某一国际组织并负责同该国或该组织保持经常联系的代表;临时外交代表指临时出国担负有某种特定任务的代表。《中华人民共和国驻外外交人员法》中将外交人员定义为驻外国使馆、领馆以及常驻联合国和其他政府间国际组织代表团等机构中具有外交衔级的人员,馆长是上述机构的行政首长。我国的外交衔级有大使、公使、参赞、一等秘书、二等秘书、三等秘书、随员。根据《维也纳外交关系公约》和《中华人民共和国特权与豁免条例》,使馆馆长和具有外交衔级的外交人员统称为“外交代表”,这是广义上的外交代表。一、外交代表的等级和分类确定外交代表的等级是建交双方在同意建立外交关系时需要商定的要点之一。外交代表的等级应是对等的,并且明确见之于建交公报或其他建交文书中。理论上外交代表有特命全权大使、特命全权公使和代办。(一)特命全权大使,简称大使,是最高一级的外交代表,系一国元首向另一国元首派遣的代表。享有完全的外交特权和豁免权,并享有比其他两个等级的外交代表更高的礼遇。在现代外交实践中,互派大使级外交代表是各国通行做法。国际上与大使列为同等地位的外交代表还有高级专员。高级专员是英联邦各成员国之间互相派遣的外交代表。在以英女王为元首的英联邦国家之间,高级专员由总理向总理派遣。在《维也纳外交关系公约》中教廷大使是和大使同一等级的外交代表。教廷大使是梵蒂冈教皇派出的大使。(二)特命全权公使,也是一国元首向另一国元首派遣的外交代表,只是其所受礼遇次于大使,所享有的外交特权和豁免权与大使相同。第二次世界大战以后,任命特命全权公使一级的外交代表已越来越少,绝大多数国家都把特命全权公使升格为特命全权大使。我国建国初期曾与北欧一些国家互派特命全权公使,后均升格为大使。目前各国驻外使团多设有公使这一职衔,但与这里所说的特命全权公使不同。大使馆内的公使是外交代表机关中在礼宾次序上仅次于大使的一级外交官员,其任命同其他外交官一样,无需事先征得驻在国的同意。此外,列为特命全权公使级外交使节的还有教廷公使,其派遣情况与教廷大使相同。(三)代办,是由一国外交部长向另一国外交部长派遣的,它是最低一级的外交代表。代办所受礼遇低于大使、公使,但所享有的外交特权和豁免权与大使、公使相同。1954年以后我国先后与英国、荷兰根据双方政府协议,曾互派代办,其任务是继续谈判建立外交关系事宜并办理侨务和商务业务。这是建立正常外交关系前的一种特殊做法。区别于常任代办,临时代办是在使馆馆长休假、离职、因故不能视事时,临时代理主持馆务的外交人员。临时代办不是外交代表的一个等级,一般由外交代表机关主管政务的外交人员中级别最高者担任。外交人员被任命为临时代办均不必事先征得驻在国的同意。二、特使(临时外交代表)特使,为临时执行某项使命而派遣的外交代表,又称临时外交代表。我国的特使是指由国家主席或者政府派出、赴他国履行特定礼仪性或者政治性任务的正式代表,可分为国家主席特别代表、国家主席特使、中国政府代表。我驻外机构馆长也可担任国家主席特别代表、国家主席特使、中国政府代表。国际上,特使通常由国家元首或政府首脑派遣,称为总统(国王)特使或政府代表。特使按其所担负的使命可分为礼仪性的和政治性两类。礼仪性是指出席外国国家元首就职(加冕)典礼、国庆(独立)日、重要合作项目开(竣)工仪式,吊唁外国领导人或者前政要,参加葬礼等活动。政治性是指就专门问题赴有关国家、国际和地区组织履行访问、谈判、交涉、磋商、斡旋、转达口信或者信函等任务,以及应外国政府或者国际、区域、专门组织邀请出席双、多边会议活动。根据国际惯例,特使的身份可由特使证书、正式照会或其他官方文电来确认。特使在其使命完成归国后,其特使身份即告终止。有的国家还设无任所大使,亦称巡回大使。无任所大使不是常驻某国的使节,而是专门处理某项事务的使节。三、大使的任命和到任活动根据国际惯例,在正式任命特命全权大使(高专等使节)前,派遣国须向对方提供新任外交代表简历征求接受国的同意。接受国复招提名同意后,使节方可上任。新任大使抵达接受国的时间应及时通知接受国外交部。抵达该国首都时,一般由礼宾司负责人或其他外交部官员迎接。新任大使抵达接受国后,应尽快向外交部或礼宾司负责人递交国书副本,之后向接受国国家元首呈递国书。按国际习惯,一般认为新任大使递交国书或国书副本后即开始履行职务。在我国,外国新任大使递交国书副本后即可参加礼仪活动,但到任日期以递交国书之日为准。新任大使到任后要向驻在国政府官员进行礼节性拜会。对当地的外交团则应以正式照会发出就任通知书。对外交团礼节性拜会一般先从拜会外交团团长开始。新任大使可举行到任招待会,邀请驻在国有关官员和各国使节。有些驻在国官方亦为新任使节举行招待会或宴会,邀请新任使节夫妇和外交官出席。四、外交代表职务的终止和离任活动外交代表的职务有下列情形之一者即为终止:任期届满,被本国政府召回另有任用;使节逝世;被驻在国政府宣布为“不受欢迎的人”;两国发生战争或因其他事件而使外交关系破裂中断;建交国一方发生政变以及使节被解除职务或使节自愿离职等。正常情况下的离任,使节通常以照会通知驻在国外交部、驻在地的各国外交代表机关以及驻当地有来往的各国外交使节。在照会里应告以临时代办的姓名;向驻在国元首、政府首脑、有关官员以及平日有交往的使节提出辞行拜会;举行离任招待会等。驻在国政府按其习惯做法为离任使节举行饯行活动,包括领导人会见、组织饯行宴会以及授勋等。有的外交团团长会出面举行招待会为即将离任的大使践行。使节离任回国时,驻在国外交部一般派代表赴机场(车站)送行。各国使节酌情为其送行。 【阅读更多】

  • 各省、自治区、直辖市人民政府,国务院各部委、各直属机构:《港澳台居民居住证申领发放办法》已经党中央、国务院同意,现印发给你们,请认真贯彻执行。国务院办公厅 2018年8月6日港澳台居民居住证申领发放办法第一条 为便利港澳台居民在内地(大陆)工作、学习、生活,保障港澳台居民合法权益,根据《居住证暂行条例》的有关规定,制定本办法。第二条 港澳台居民前往内地(大陆)居住半年以上,符合有合法稳定就业、合法稳定住所、连续就读条件之一的,根据本人意愿,可以依照本办法的规定申请领取居住证。未满十六周岁的港澳台居民,可以由监护人代为申请领取居住证。第三条 港澳台居民居住证登载的内容包括:姓名、性别、出生日期、居住地住址、公民身份号码、本人相片、指纹信息、证件有效期限、签发机关、签发次数、港澳台居民出入境证件号码。公民身份号码由公安机关按照公民身份号码国家标准编制。香港居民公民身份号码地址码使用810000,澳门居民公民身份号码地址码使用820000,台湾居民公民身份号码地址码使用830000。第四条 各级公安机关应当积极协调配合港澳事务、台湾事务、发展改革、教育、民政、司法行政、人力资源社会保障、住房城乡建设、交通运输、卫生健康等有关部门,做好居住证持有人的权益保障、服务和管理工作。第五条 各级公安机关应当建立完善港澳台居民居住证管理信息系统,做好居住证申请受理、审核及证件制作、发放、管理工作。第六条 港澳台居民居住证的有效期限为五年,由县级人民政府公安机关签发。第七条 港澳台居民居住证采用居民身份证技术标准制作,具备视读与机读两种功能,视读、机读的内容限于本办法第三条规定的项目。港澳台居民居住证的式样由公安部商国务院港澳事务办公室、国务院台湾事务办公室制定。港澳台居民居住证由省级人民政府公安机关统一制作。第八条 港澳台居民申请领取居住证,应当填写《港澳台居民居住证申领登记表》,交验本人港澳台居民出入境证件,向居住地县级人民政府公安机关指定的公安派出所或者户政办证大厅提交本人居住地住址、就业、就读等证明材料。居住地住址证明包括房屋租赁合同、房屋产权证明文件、购房合同或者房屋出租人、用人单位、就读学校出具的住宿证明等;就业证明包括工商营业执照、劳动合同、用人单位出具的劳动关系证明或者其他能够证明有合法稳定就业的材料等;就读证明包括学生证、就读学校出具的其他能够证明连续就读的材料等。第九条 居住证有效期满、证件损坏难以辨认或者居住地变更的,持证人可以换领新证;居住证丢失的,可以申请补领。换领补领新证时,应当交验本人港澳台居民出入境证件。换领新证时,应当交回原证。第十条 港澳台居民申请领取、换领、补领居住证,符合办理条件的,受理申请的公安机关应当自受理之日起20个工作日内发放居住证;交通不便的地区,办理时间可以适当延长,但延长的时间不得超过10个工作日。第十一条 港澳台居民在内地(大陆)从事有关活动,需要证明身份的,有权使用居住证证明身份,有关单位及其工作人员不得拒绝。第十二条 港澳台居民居住证持有人在居住地依法享受劳动就业,参加社会保险,缴存、提取和使用住房公积金的权利。县级以上人民政府及其有关部门应当为港澳台居民居住证持有人提供下列基本公共服务:(一)义务教育;(二)基本公共就业服务;(三)基本公共卫生服务;(四)公共文化体育服务;(五)法律援助和其他法律服务;(六)国家及居住地规定的其他基本公共服务。第十三条 港澳台居民居住证持有人在内地(大陆)享受下列便利:(一)乘坐国内航班、火车等交通运输工具;(二)住宿旅馆;(三)办理银行、保险、证券和期货等金融业务;(四)与内地(大陆)居民同等待遇购物、购买公园及各类文体场馆门票、进行文化娱乐商旅等消费活动;(五)在居住地办理机动车登记;(六)在居住地申领机动车驾驶证;(七)在居住地报名参加职业资格考试、申请授予职业资格;(八)在居住地办理生育服务登记;(九)国家及居住地规定的其他便利。第十四条 国家机关及其工作人员对在工作过程中知悉的居住证持有人个人信息,应当予以保密。第十五条 港澳台居民居住证持证人有下列情形之一的,其所持居住证应当由签发机关宣布作废:(一)丧失港澳台居民身份的;(二)使用虚假证明材料骗领港澳台居民居住证的;(三)可能对国家主权、安全、荣誉和利益造成危害的;(四)港澳台居民出入境证件被注销、收缴或者宣布作废的(正常换补发情形除外)。第十六条 违反规定办理、使用居住证的,依照《居住证暂行条例》的有关规定予以处罚。国家机关及其工作人员违反居住证管理相关规定的,依法给予处分;构成犯罪的,依法追究刑事责任。第十七条 首次申请领取居住证,免收证件工本费。换领、补领居住证,应当缴纳证件工本费。具体收费办法参照《居住证暂行条例》的有关规定执行。第十八条 港澳台居民迁入内地(大陆)落户定居的,按照有关规定办理,不适用本办法。第十九条 本办法所称“港澳台居民”是“港澳居民”和“台湾居民”的统称。其中,“港澳居民”是指在香港、澳门特别行政区定居且不具有内地户籍的中国公民;“台湾居民”是指在台湾地区定居且不具有大陆户籍的中国公民。本办法所称“港澳台居民居住证”,包括中华人民共和国港澳居民居住证、中华人民共和国台湾居民居住证。本办法所称“港澳台居民出入境证件”,包括港澳居民来往内地通行证、五年期台湾居民来往大陆通行证。第二十条 省、自治区、直辖市人民政府可以结合本行政区域综合承载能力和经济社会发展需要等因素,根据本办法制定实施细则。第二十一条 本办法自2018年9月1日起施行。 【阅读更多】
  • 一九八六年十二月三日国务院批准一九八六年十二月二十五日公安部公布第一章 总 则第一条 根据《中华人民共和国公民出境入境管理法》第十七条的规定,制定本办法。 第二条 本办法适用于内地公民因私事往来香港地区(下称香港)或者澳门地区(下称澳门)以及港澳同胞来往内地。 第三条 内地公民因私事前往香港、澳门,凭我国公安机关签发的前往港澳通行证或者往来港澳通行证从指定的口岸通行;返回内地也可以从其他对外开放的口岸通行。指定的口岸:往香港是深圳,往澳门是拱北。 第四条 港澳同胞来往于香港、澳门与内地之间,凭我国公安机关签发的港澳同胞回乡证或者入出境通行证,从中国对外开放的口岸通行。 第二章 内地公民前往香港、澳门第五条 内地公民因私事前往香港、澳门定居,实行定额审批的办法,以利于维护和保持香港和澳门的经济繁荣和社会稳定。 第六条 内地公民因私事前往香港、澳门,须向户口所在地的市、县公安局出入境管理部门提出申请。 第七条 有下列情形之一的,可以申请前往香港、澳门定居:(一)夫妻一方定居香港、澳门,分居多年的;(二)定居香港、澳门的父母年老体弱,必须由内地子女前往照料的;(三)内地无依无靠的老人和儿童须投靠在香港、澳门的直系亲属和近亲属的;(四)定居香港、澳门直系亲属的产业无人继承,必须由内地子女去定居才能继承的;(五)有其他特殊情况必须去定居的。 第八条 有下列情形之一的,可以申请短期前往香港、澳门:(一)在香港、澳门有定居的近亲属,须前往探望的;(二)直系亲属或者近亲属是台湾同胞,必须由内地亲人去香港、澳门会亲的;(三)归国华侨的直系亲属、兄弟姐妹和侨眷的直系亲属不能回内地探亲,必须去香港、澳门会面的;(四)必须去香港、澳门处理产业的;(五)有其他特殊情况,必须短期去香港、澳门的。 第九条 内地公民因私事申请前往香港、澳门,须回答有关的询问并履行下列手续:(一)交验户口簿或者其他户籍证明;(二)填写申请表;(三)提交所在工作单位对申请人前往香港、澳门的意见;(四)提交与申请事由相应的证明。 第十条 本办法第九条第四项所称的证明是指:(一)夫妻团聚,须提交合法婚姻证明,以及配偶在香港、澳门有永久居住资格的证明;(二)去香港、澳门照顾年老体弱父母或者无依无靠的老人、儿童投靠香港、澳门亲属,须提交与香港、澳门亲属关系及其在香港、澳门有永久居住资格的证明;(三)继承或者处理产业,须提交产业状况和合法继承权的证明;(四)探望在香港、澳门亲属,须提交亲属函件;时间急迫的,应尽可能提交与申请事由相关的说明或者证明;(五)会见台湾亲属或者会见居住国外的亲属,须提交亲属到达香港、澳门日期的确切证明。 第十一条 公安机关出入境管理部门受理的前往香港、澳门的申请,应当在六十天内作出批准或者不批准的决定,通知申请人。 第十二条 经批准前往香港、澳门定居的内地公民,由公安机关出入境管理部门发给前往港澳通行证。持证人应当在前往香港、澳门之前,到所在地公安派出所注销户口,并在规定的时间内前往香港、澳门。经批准短期前往香港、澳门的内地公民,发给往来港澳通行证。持证人应当在规定时间内前往并按期返回。 第十三条 内地公民申请去香港、澳门,有下列情形之一的,不予批准:(一)属于《中华人民共和国公民出境入境管理法》第八条规定情形的;(二)不属于本办法第七条和第八条规定情形的;(三)编造情况、提供假证明,欺骗公安机关出入境管理部门的。 第三章 港澳同胞来内地第十四条 港澳同胞来内地,须申请领取港澳同胞回乡证。港澳同胞回乡证由广东省公安厅签发。申领港澳同胞回乡证须交验居住身份证明、填写申请表。不经常来内地的港澳同胞,可申请领取入出境通行证。申领办法与申领港澳同胞回乡证相同。 第十五条 有下列情形之一的,不发给港澳同胞回乡证或者入出境通行证:(一)被认为有可能进行抢劫、盗窃、贩毒等犯罪活动的;(二)编造情况,提交假证明的;(三)精神病患者。 第十六条 港澳同胞驾驶机动车辆来内地,应当按照广东省人民政府有关规定申请行车执照,驾驶人员还须向广东省公安厅出入境管理处申请驾驶港澳机动车辆来往内地的许可。 第十七条 港澳同胞短期来内地,要按照户口管理规定,办理暂住登记。在宾馆、饭店、旅店、招待所、学校等企业、事业单位或者机关、团体及其他机构内住宿的,应当填写临时住宿登记表;住在亲友家的,由本人或者亲友在二十四小时内(农村可在七十二小时内)到住地公安派出所或者户籍办公室办理暂住登记。 第十八条 港澳同胞要求回内地定居的,应当事先向拟定居地的市、县公安局提出申请,获准后,持注有回乡定居签注的港澳同胞回乡证,至定居地办理常住户口手续。 第四章 出入境检查第十九条 内地公民往来香港、澳门以及港澳同胞来往内地,须向对外开放口岸或者指定口岸的边防检查站出示出入境证件,填交出境、入境登记卡,接受查验。 第二十条 有下列情形之一的,边防检查站有权阻止出境、入境:(一)未持有往来港澳通行证件、港澳同胞回乡证或其他有效证件的;(二)持用伪造、涂改等无效的往来港澳通行证件或者港澳同胞回乡证,冒用他人往来港澳通行证件或者港澳同胞回乡证的;(三)拒绝交验证件的。具有前款第二项规定的情形的,并可依照本办法第二十六条的规定处理。 第五章 证件管理 第二十一条 港澳同胞回乡证由持证人保存,有效期十年,在有效期内可以多次使用。超过有效期或者查验页用完的,可以换领新证。申请新证按照本办法第十四条规定办理。     第二十二条 前往港澳通行证在有效期内一次使用有效。往来港澳通行证有效期五年,可以延期二次,每次不超过五年,证件由持证人保存、使用,每次前往香港、澳门均须按照本办法第六条、第八条、第十条的规定办理申请手续,经批准的作一次往返签注。经公安部特别授权的公安机关可以作多次往返签注。 第二十三条 港澳同胞来内地后遗失港澳同胞回乡证,应向遗失地的市、县或者交通运输部门的公安机关报失,经公安机关调查属实,出具证明,由公安机关出入境管理部门签发一次有效的入出境通行证,凭证返回香港、澳门。港澳同胞无论在香港、澳门或者内地遗失港澳同胞回乡证,均可以按照本办法第十四条规定重新申请领取港澳同胞回乡证。    第二十四条 内地公民在前往香港、澳门之前遗失前往港澳通行证、往来港澳通行证的,应立即报告原发证机关,并由本人登报声明,经调查属实的,重新发给证件。 第二十五条 港澳同胞回乡证持证人有本办法第十五条规定情形之一的,证件应予以吊销。吊销证件由原发证机关或其上级机关决定并予以收缴。第六章 处 罚 第二十六条 持用伪造、涂改等无效的或者冒用他人的前往港澳通行证、往来港澳通行证、港澳同胞回乡证、入出境通行证的,除可以没收证件外,并视情节轻重,处以警告或五日以下拘留。 第二十七条 伪造、涂改、转让前往港澳通行证、往来港澳通行证、港澳同胞回乡证、入出境通行证的,处十日以下拘留;情节严重,构成犯罪的,依照《中华人民共和国刑法》的有关条款的规定追究刑事责任。 第二十八条 编造情况,提供假证明,或者以行贿等手段,获取前往港澳通行证、往来港澳通行证、港澳同胞回乡证、入出境通行证,情节较轻的,处以警告或五日以下拘留;情节严重,构成犯罪的,依照《中华人民共和国刑法》的有关条款的规定追究刑事责任。 第二十九条 公安机关的工作人员在执行本办法时,如有利用职权索取、收受贿赂或者有其他违法失职行为,情节轻微的,可以由主管部门酌情予以行政处分;情节严重,构成犯罪的,依照《中华人民共和国刑法》的有关条款的规定追究刑事责任。 第七章 附 则第三十条 本办法由公安部组织实施,负责解释。 第三十一条 本办法自公布之日起施行。 【阅读更多】

广西外办能否受理外省(区、直辖市)公证机构出具的涉外公证书、商业文书的领事认证?
不可以。根据外交部授权,被委托的地方外办只能办理本省(区、直辖市)内的公证机构或其他机构出具的涉外公证书、商业文书的领事认证,不能为其他省(区、直辖市)出具的文书办理领事认证。外省(区、直辖市)出具的文书必须向出证机构所在地的省区市外事办公室申办(或委托代办)领事认证。

什么样的文书不能办理附加证明书?
